On 28 January 2010 the European Court of Justice held in Uniplex (UK) Ltd v NHS Business Services Authority (C 406/08) that “judicial review style” time limits in UK public procurement regulations are contrary to EC law – the period for bringing public procurement infringement proceedings is to begin on the date on which the claimant knew, or ought to have known, of the alleged infringement – and not on the date of the alleged infringement.
